Terms and Conditions of Sale and Operational Notes
- Arrival Time and Delays: On the day of the activity, customers must arrive at the office 30 minutes before the scheduled start of the experience to complete all preliminary procedures, briefing, and equipment fitting. In the event of a delay by the customer, the organization cannot guarantee that the activity will take place, and the customer shall not be entitled to any refund or rescheduling.
- Cancellation Before the Start: The organization reserves the right to cancel the experience, at its sole discretion and at any time before the start, due to force majeure, safety concerns, adverse weather conditions, and/or failure to reach the minimum number of participants required to run the experience (4 people). In such cases, the customer shall have no claim for compensation, indemnity, or reimbursement of additional expenses beyond the amount already paid.
- Suspension, Reduction, or Modification During the Activity: The organization, including through its instructors, guides, and accompanying staff, may decide at any time to suspend, shorten, modify, or reschedule the experience while it is in progress if circumstances arise relating to participant safety, sudden changes in weather or environmental conditions (including water levels or route accessibility), or the physical and mental suitability of participants. Such changes are implemented exclusively to ensure maximum safety, do not constitute a contractual breach, and do not entitle the customer to full or partial refunds.
- Ordinary Bad Weather: Activities are guaranteed and will normally take place even in the event of rain or ordinary bad weather, subject to the safety assessments described in the previous sections.
- Mandatory Online Check-In: Access to any activity offered in the catalogue is permitted exclusively upon completion of the mandatory online check-in during the booking process.
- Physical Fitness and Liability Waiver: Customers must carefully read and accept the liability waiver during the online check-in process. By accepting it, they confirm that they possess the physical and mental conditions required to participate in the selected activity and that they are not aware of any health issues that could compromise the safe and proper execution of the experience.
- Legal Framework of the Purchase: These general terms and conditions govern the purchase of services at a distance through this website, in accordance with the provisions of Italian Legislative Decree No. 206 of 6 September 2005 (Consumer Code) and Regulation (EU) 2016/679 (GDPR) concerning the protection of personal data.
Cancellation, Withdrawal and Refund Policy
- Fiscal and Contractual Framework (Confirmation Deposit – Caparra Confirmatoria): The total amount paid during the online booking process constitutes a payment by way of a confirmation deposit (caparra confirmatoria) pursuant to Article 1385 of the Italian Civil Code. The transaction is temporarily excluded from the scope of VAT at the time of electronic payment. The final consideration and the issuance of the related electronic commercial document (tax receipt with 22% VAT) will take place exclusively on the day the activity is actually carried out. The booking confirmation sent by email has solely contractual value and does not constitute a fiscal document.
- Standard Cancellation Policy (More Than 48 Hours Before the Activity): The Customer has the right to withdraw from the contract and obtain a refund of the deposit paid, exclusively by sending a written communication to This email address is being protected from spambots. You need JavaScript enabled to view it., provided that such communication is received at least 48 hours before the scheduled date and time of the activity. Refunds will be processed net of any banking or transaction fees charged by the payment gateway, which shall remain the responsibility of the Customer.
- Legal Exclusion of the Right of Withdrawal (Cooling-Off Period): The Customer is expressly informed that, pursuant to Article 59, paragraph 1, letter n) of Italian Legislative Decree No. 206 of 6 September 2005 (Consumer Code), the statutory right to withdraw from a distance contract within 14 days of purchase does not apply to contracts concerning leisure services where the contract provides for a specific date or period of performance. Consequently, refunds are governed solely and exclusively by the company's 48-hour cancellation policy described above.
- Late Cancellation, Delays and No-Shows (Within 48 Hours): No refund, compensation or rescheduling will be granted for cancellations communicated within 48 hours prior to the activity, in the event of late arrival, or in the event of failure to attend (No-Show). In such circumstances, the organization shall be entitled to retain the full amount of the confirmation deposit as liquidated damages for contractual breach pursuant to Article 1385, paragraph 2 of the Italian Civil Code. Such retained amounts are expressly excluded from the VAT taxable base pursuant to Article 15, paragraph 1, no. 1 of Presidential Decree No. 633/72.
- Cancellation by the Organization: Should the experience be cancelled by the organization before its commencement due to failure to reach the minimum number of participants required (4 people), force majeure, safety concerns, or prohibitive weather or environmental conditions, the Customer shall be entitled exclusively to either reschedule the experience for another agreed date or receive a full refund of the amount paid online at the time of booking. Any claim for damages, compensation, indemnity, or reimbursement of ancillary expenses, including travel, accommodation, or other logistical costs, is expressly excluded.
